Copying in my post from the devs forum.

I am extremely pissed off about this. I had already bought GW:EN since I hadn't really paid attention to the offer details. Then when I read on guru that it WOULD NOT be put on sale I looked at the details properly. It seemed perfectly clear that the ONLY way to EVER get BMP was spend money in online store. Plus that could very well be the one and only chance to do so.

Therefore I spent £18 on character slots I don't need, to be sure I had it.

Now they turn around and say it will be on sale?

Fine let me return my 3 character slots for a refund then I will buy the BMP for much less.

You sold me those slots by lying to me.

Plus I like having the box for games I play.

I am sure trading standards authorities would be interested in this sort of malpractice.

The way the BMP works, early uptake is worth precisely nothing. You can't profit from anything gained through it.

I have copied this post into a support ticket I have just sent. I better get a refund or I will find out what trading standards do make of this.

EDIT

Just want to say that the Walmart/Wii comparison is the stupidest thing I have ever read. A Wii can be bought from many different stores, we all know the RRP. The BMP we were led to believe was ONLY EVER available by making online store purchases. If we already had every other thing you could buy in the store the ONLY OPTION to EVER get the BMP (we were led to believe) was buying 3 unneeded/unwanted character slots.

They lied to us to make us spend money we wouldn't otherwise have done. And now that the 'distance buying' legislation deadline is safely passed they go back on what they said. It is fraud plain and simple.

Ok see, I can sympathise with your situation. A person who already owned GWEN before the promotion and then felt the had to spent £17 on something ethey didnt really want to get the BMP from the online store. I was in the exact same situation, except I didnt buy the BMP at all.

But still...

...I (along with others) could have done that to get the BMP, but we didnt!

I think you have to accept a certain level of niavity in not realising the BMP would eventually be sold seperately or daftness for falling for such a blatently nasty promotion! I know that probably wont go down well what I just wrote and im sorry. But Anet didnt force you into buying the product and they didnt state (to my knowledge) that the promotion would be the ONLY way to buy it.

Its like me jumping early into the high definition war between HD DVD and BD. Blu ray is now blatenly winning and I have bought quite a few HD DVD films for my xbox360 HD DVD drive. Had I waited and had some intelligence, I would have waited until the format war sorted itself out and then I would have known to invest in BD and not HD DVD. But I didnt wait! But I cant now turn around and ask for my money back on all my HD DVD films and my HD DVD player because I chose to buy them the second the new technology came out.

Just as you decided to spend money to get the BMP the second it was released. You could have waited like hundreds of others for it to be sold seperately, but you didnt.

You could have waited and seen how it sorted itself out, but you wanted to jump in the minute the BMP was released. Now those who did that are suffering. It was a bad move by Anet and it should have been released seperately, but they havent broken any laws or rules or miss-lead or lied at all.

Show me the quote stating you would ONLY ever be able to get the BMP during the promotion and NO WHERE else?

You really wont have a leg to stand on, in asking for your money back! Its not Anet's fault that you spent £18 to get the BMP by buying character slots.

Are some people here seriously raging about 10/20 dollars?

W0Rd!

Know what I hope? I hope ANet sends all the GW players in... oh... Korea, a check for $500, and a special pre-release copy of GW2, and I hope Gaile flies over there and personally hands them out, along with new Porsches, a new gaming computer, and the congressional medal of honor. Furthermore, I hope that from now on, ANet just gives away new game updates and games for FREE to everyone in... oh... Sweden. Why? Favoritism, plain and simple. I'm not joking. I hope they come right out and say it. "We like Swedes better."

Cause in the end, it don't affect my gameplay one bit.

Looks like i'll be getting the BMP

And to everypme sat at their computers having QQ fits...

You got access before us. Technically, you did get it free, as you chose to pay the extra in the online store to get the weekend AND the BMP. Your being selfish, "OMG i payed extra and got something earlier - now its cheaper and everyones gonna have it! QQ"

Grow up. Its a business, this is what businesses do - sell things to make income. Maybe this extra income will improve GW2? Who knows.

Stop the QQ. Stop the whining. This is a game, have your fights about whos more epic someplace else.

You missed his point. If people are pissed because of $10 or $20 they probably have bigger financial issues to take care of before they should be wasting time with something so stupid.

Yes we are 'raging' about 10-20 dollars. But it isn't the amount it is the principal.

Even if Anet didn't categorically state it would not be available any other way, their wording was deliberately ambiguous enough that a great many people (myself included) believed that was the case. That is why so many people joined in with 'petitions' to make it available in future and why Gaile felt she had to push forward the case for people who wanted it.

Unfortunately Anet have now updated the website pages regarding the promotion, so we can't examine the ambiguous wording. But as the only people able to provide information and as the ones providing the service, surely there is a duty of care, that rests with the company, to ensure people are not misled into spending £18 to acquire a product which they can get in the (very near) future (with box) for £6.

If there offer was promoted as :

Limited offer bonus missions free if you spend....... ect.

Then you have no rights and no reason to moan, the limited is the implication that it's free for you who meet the requirments, that the only thing you needed to read to understand it.

If on the other hand it said:

Only chance to ever get the limited bonus missions when you spend....ect.

It didn't but that would be a case due to them telling you its a one time offer. My opinion: Suck it up sorry.

Interesting point, concisely put.

You heard about people successfully sueing for slipping on a wet floor despite a sign? Or burning themselves with hot coffee? Or people who were sold endowment policies and were unaware of the risks being compensated for shortfalls?

If enough of us feel that we have been misled in this case, I am pretty sure a successful class action could be brought against Anet. I am not saying that is what I want to do. But Anet should take more care that their customers aren't made to feel like this.

To be honest, i don't have a clue what a checking account is and have never heard that phrase before. Sorry but i cannot get a debit card at 17, my bank and several others i checked all require you to be of 18 years old before you can get one.

I know you can use the plaync store with prepaids, i stated that, i forgot to put in that you could only purchase EotN from said store and nothing else which is available from the in game store which would actually have been of use (char slots etc).

And the 30USD/£15 part, i'd happily pay that for the BMP, the price isnt a problem.

That section sounds like nothing more than legal talk. They aren't stating that this will be the one and only time you will be able to obtain the BMP, but is to stop people from believing they will be able to transfer it between accounts, give it to friends, etc. And regardless, that doesn't give Anet any less right to offer it again by other methods.

I'm sure someone can explain that better than me, but it was said pretty well before. Those of you who believed this content would be completely exclusive were pretty niave..

Er no. That just says, in plain English mind you, that the BMP will be available through this promotion for the account that complies with the promotion rules. It nowhere states they would not be offering it at a later time.
